GAMA releases a Statement regarding the Supreme Court’s Decision to Strike Down IEEPA Tariffs

On Friday, the US Supreme Court struck down President Trump‘s tariffs set under the International Emergency Economic Power Act. What this means for all of the tariffs already collected is unknown and the impact on retail prices are also unknown.

The decision was praised by numerous publishers and organizations within the geek and entertainment space. GAMA: The Tabletop Game Association released the below statement yesterday:

GAMA: The Tabletop Game Association applauds today’s decision by the U.S. Supreme Court which struck down the tariffs imposed by President Donald Trump under the International Emergency Economic Powers Act (IEEPA), ruling that he had exceeded his authority in doing so.

Trump promptly announced he would re-impose the tariffs through other methods.

The Supreme Court issued its 6-3 decision in the case of Learning Resources Inc. et al v Trump, which had been consolidated with the case Trump v V.O.S. Solutions. GAMA had filed an amicus brief in the case in support of Learning Solutions and V.O.S., challenging this presidential overreach. GAMA argued that in the IEEPA, Congress had never intended to delegate such sweeping economic powers to the executive branch. 

In his majority ruling, Chief Justice John G. Roberts Jr. agreed, writing: “The president asserts the extraordinary power to unilaterally impose tariffs of unlimited amount, duration, and scope. In light of the breadth, history, and constitutional context of that asserted authority, he must identify clear congressional authorization to exercise it.”

It may be possible for companies that paid tariffs to apply for refunds. U.S. Treasury Secretary Scott Bessent acknowledged last September on NBC’s “Meet the Press” that the agency would issue refunds if ordered to do so by the Supreme Court. GAMA is researching how businesses in our industry that paid tariffs could apply for refunds and will share information as we have it. 

GAMA’s support for Learning Resources and V.O.S. Solutions stems from a shared commitment to constitutional governance and economic stability. The unchecked use of IEEPA to alter tariffs threatened not only businesses but the very principle of separation of powers enshrined in Article I of the U.S. Constitution. 

GAMA continues to monitor the Trump administration’s actions regarding tariffs.

GAMA Executive Director John Stacy announces his Departure

GAMA: The Tabletop Game Association (GAMA) has announced that Executive Director John Stacy will step down from his role this November, marking the end of a transformative seven-year tenure. Stacy will be transitioning to a new leadership position at a trade association in the medical field.

Since joining GAMA in December 2018, Stacy joined GAMA in December 2018 and during the seven years the organization saw growth and expansion. Under his leadership, GAMA’s membership expanded by 55%, growing from 980 companies to 1,778 across 36 countries. The organization’s staff nearly tripled, enabling the launch of key initiatives such as the Horizon Fellowship, Game Store Day, the GAMA Resource Hub, Around the Table magazine, and the Winter Wishlist retail buying guide. 

Stacy also spearheaded the evolution of GAMA Expo, transforming it from a hotel-based event into a 300,000-square-foot convention center showcase. Attendance more than doubled to 3,425 in 2025. The event now features hosted media, expanded exhibitor space, creator playtesting zones, and a robust educational program. 

Beyond events, Stacy led efforts to modernize GAMA’s membership structure, establish a code of conduct, and build advocacy programs addressing tariffs, IP rights, counterfeit protections, and product labeling. During the pandemic, he guided the organization through rapid pivots to virtual programming and retailer support, while mobilizing industry-wide advocacy for federal relief. 

Stacy’s departure aligns with the conclusion of his contract at year’s end. The GAMA Board of Directors has initiated a leadership transition process with an interim executive director while they search for a new leader who will be focused on implementing its ambitious 10-year strategic plan.

GAMA Calls a Special Election for a Media & Events Member Representative

After five years of service on the GAMA Board of Directors, including pivotal work during GAMA’s 2020 restructuring, Secretary Monica Rasso is stepping down. The owner of Tabletop Enterprises LLC and a Media & Events Member of GAMA, Monica was one of the first directors elected after the organization’s restructuring five years ago. She played a key role in guiding GAMA through that pivotal period and since then has often held board leadership roles, including vice president and secretary. 

Monica’s departure creates a Media & Events vacancy on the board, and pursuant to GAMA’s bylaws a special election will be held to fill the remainder of her term, which expires on March 30, 2027. Members of the Media & Events Division will receive details about the election process via email in the coming days. 

The Game Manufacturers Association Objects to Diamond’s Consignment Liquidation Plan

Publishers have been filing objections to Diamond Comic Distributor‘s motion that would allow them to sell, liquidate, dispose of, inventory it currently still hasMany publishers have already been vocal about the motion and many have responded to our inquiries with “no comment” because it’s an ongoing legal matter. So far, TwoMorrows Publishing, Magma Comix, and Graphitti DesignsAbstract StudioNBMWilliam M. Gaines, Agent, Inc., Humanoids, and most recently a joint filing by 13 publishers have each filed objections to the motion.

Now, the Game Manufacturers Association (GAMA) on behalf of Skyscraper Studios, Roll for Combat, and Liminal Esports, aka Snowbright Studio, have submitted its own objection to the motion.

GAMA takes the stand that the consigned goods are not the property of Diamond, a pretty consistent statement in objections. They’ve taken the pretty recent argument made by Humanoids, and the 13 publishers, that the publishers are not subject to Article 9 and thus did not need to file UCC-1 to protect their goods, part of Diamond’s claim. They also repeat that there are obligations in the agreements between Diamond and the publishers and if they’re not met, then it’s a “material breach.”

Much like the most recent filings, who “owns” the goods hasn’t been determine and that needs to be determined GAMA argues and an “adversary proceeding” being required.

New is that Diamond needs to fulfill their obligations under the agreements between them and the publishers and that by failing to do so would be a “material breach.” If Diamond sells the goods in this liquidation plan it’d be a violation of the agreements and any contracts that are rejected need to be approved by the Court in the bankruptcy.

GAMA goes into more detail on “administrative expense priority claims” that would be owed to the creditors, aka publishers. Since the merchandise was acquired after they declared Chapter 11, the consignors are entitled to “administrative expenses” since they helped Diamond stay afloat and conduct business after they filed.

Humanoids Objects to Diamond’s Consignment Motion. Objection Deadline Extended. GAMA enters the Chat. William M. Gaines, Agent, Inc’s Objection Has Some Issues.

Today has been a busy day when it comes to Diamond Comic Distributor‘s Chapter 11 process. All of it revolves around Diamond’s motion regarding consignment merchandise they still have. On June 25, 2025, Diamond Comic Distributors submitted the motion that would allow them to sell, liquidate, dispose of, inventory it currently still hasMany publishers have been vocal about the motion and many have responded to our inquiries with “no comment” because it’s an ongoing legal matter. So far, TwoMorrows Publishing, Magma Comix, and Graphitti Designs, Abstract Studio, NBM, and William M. Gaines, Agent, Inc. have each filed objections to the motion.

The deadline for the objections to be filed was supposed to be today, July 16, but Diamond and Image Comics have submitted a stipulation to extend the deadline to July 18, 2025 at 12:00 p.m. (ET).

Humanoids submitted their own objection to the motion. First, Humanoids says that the merchandise isn’t consignment at all and doesn’t meet the criteria to be. If it’s not consignment, then Diamond doesn’t have the right to do what they want. And, there needs to be an entire process regarding this to determine what the merchandise is and who “owns” it. Humanoids claims Diamond’s motion is the wrong process.

The filing is the most impressive so far. It goes beyond the distribution agreement or just stating it’d be a negative impact for business, Humanoids’ filing goes into other similar cases and rulings, making a very sound legal argument.

It’s a solid read overall.

William M. Gaines, Agent, Inc.‘s objection filed earlier today has some issues that need to be fixed according to the Clerk of Court.

The attorney that filed the motion is not by an individual or by a member of the court undertaking this. So, the lawyer needs “Admission Pro Hac Vice,” basically to be approved by the court to practice in this court/state.

Finally, the Game Manufacturers Association (GAMA) has entered the court proceedings. Some game publishers have been impacted and were named in Diamond’s motion to sell the merchandise. They’ve asked for James R. Irving to admitted to the court. He’s a member in good standing in multiple other courts. GAMA is a potentially a pretty big heavy hitter getting involved in the legal mess.

Panini America Reveals a Justice League TCG

At the GAMA Trade Show, Panini America revealed it’ll be launch a new trading card game, Meta-X Justice League TCG. The game will debut at San Diego Comic-Con with a retail release after.

The game will use are from the New-52 era of DC Comics and the first set will be over 250 cards. The game is a part of a bigger plan for Panini in their use of the card game engine. The Meta-X engine will be able to be used with multiples IPs and future games will use it allowing for multiple IPs to be used in the same game. It’s a similar idea as WizKids’ Dice Masters which has one game engine that’s used across intellectual property which allows you to mix and match.

The focus is an “easy entry into the game” where new players can learn the game in five minutes. The game will be sold in Starters and Boosters.

Game Manufacturers Partner with Wizard World

Columbus, OH (July 27, 2011) – The Game Manufacturers Association (GAMA) is pleased to announce its partnership with Wizard World, Inc. (symbol: WIZD), producer of North America’s largest pop-culture tour.  GAMA is supporting the two shows to include a trade day and gaming events at Wizard World Shows.  The first, Chicago Comic Con, will take place at the Donald E. Stevens Convention Center in Rosemont, Ill., August 11-14, and the second, Mid-Ohio Comic Con at the Greater Columbus Convention Center on October 22-23.

“GAMA is thrilled to be partnering with Wizard World,” said John Ward, Executive Director. “GAMA and Wizard World are totally dedicated to making this a success.  I think this program provides a great crossover between the two entities.”

“We are excited about teaming with GAMA to highlight tabletop gaming, which has been an important part of Wizard World events,” said Gareb Shamus, Wizard World CEO.  “We are also pleased that Chicago Comic Con will serve as a venue to showcase the prestigious Origin Awards.”

The Trade Day will be a one day event on August 11 which will be free to all retailers.  This will include professional seminars by the GAMA staff and products demonstrated by Wiz Kids.

GAMA is also pleased to announce demonstrations in its gaming area in the exhibit hall.  The demonstrations will include its 2011 Origins Awards winners as well as the 2012 submissions.  The Origins Awards are presented annually by the Academy of Gaming Arts and Designs to recognize outstanding achievement in design and production of games and game related products.
