It’s a new week so lets kick it off with more drama, twists, and turns in Diamond‘s Chapter 11 filing which began in mid-January. On April 28 Matthew W. Cheney, Acting United States Trustee for Region Four, filed a motion to convert Diamond‘s Chapter 11 to Chapter 7 or dismiss the case. The reason given was that Diamond hadn’t been doing what is required like filing Monthly Operating Reports since they filed for Chapter 11 in January.

Since then, Diamond has been playing catch up and submitted its Monthly Operating Reports for January, February, and March, and even submitted a revised report for January.

Due to that, Cheney has withdrawn the motion to convert Diamond’s Chapter 11 to Chapter 7 or dismiss the case stating, “The deficiencies noted in the motion have been cured.”
