Anthropic has agreed to pay $1.5 billion to Settle an AI Lawsuit with Authors

As we bring the news of Warner Bros. Discovery’s lawsuit against Midjourney, another case involving AI and theft is being settled. Anthropic has agreed to pay at least $1.5 billion into a class action fund as part of a settlement. The litigation was brought by a group of book authors.

The settlement releases Anthropic for it conduct up to August 25. That means new claims could be filed for any conduct after that date. Anthropic will also destroy the datasets used in its models.

The settlement amount is about $3,000 per class work.

A hearing in the case is scheduled for September 8. A “settlement in principle” was previously announced by Anthropic and the creators.

In the case, U.S. District Judge William Aslup ruled that Anthropic’s use of the books in training models was “exceedingly transformative,” a factor to determine if the use was under legal “fair use.” It was a major decision, the first concerning the issue. But, there was still a question of Anthropic pirating books from the internet to train its models, which would still need to settled in a trial.

Even though they’ll be paying $1.5 billion, it is a win for Antropic and possibly other AI companies allowing them to purchase a copy of the work, and then train their model off of it.

While $3,000 might not seem like a lot, it’s more than the $750 statutory damages amount a jury could award and more than the $200 amount if Anthropic were to prevail on its defense of innocent infringement.

2025 is absolutely going down as the year of the comic related lawsuit. We have Diamond’s chapter 11 along with all of the side suits, then there’s artists suing Cadence Comic Art. Now, Warner Bros. Discovery, along with Hanna-Barbera Productions, Turner Entertainment, DC Comics, and The Cartoon Network are suing AI startup Midjourney claiming the tech company “brazenly dispenses its intellectual property as if it were its own.” The filing was submitted September 4.

In June, Disney and Universal decided to sue Midjourney calling it a “bottomless pit of plagiarism.” In a filing, Warner Bros. Discovery highlighted that case as related.

Warner Bros. Discovery is accusing Midjourney of producing, displaying, and distributing “unauthorized derivatives” of its intellectual property including Superman, Wonder Woman, Batman, Bugs Bunny, Scooby-Doo, and more.

What’s interesting is that Warner Bros. Discovery claims that Midjourney is infringing even if specific characters aren’t mentioned. Using “classic comic book superhero battle” brings up characters like Superman, Flash, and Batman.

Warner Bros. Discovery further claims Midjourney is aware of its “breathtaking scope of its piracy and copyright infringement” but refuses to protect copyright holders.

It is hard to imagine copyright infringement that is any more willful than what Midjourney is doing here. Midjourney is purposefully exploiting Warner Bros. Discovery’s valuable intellectual property to attract subscribers to Midjourney, and it is profiting by providing subscribers with endless copies and derivatives of Warner Bros. Discovery’s Copyrighted Works.

In the filing there’s numerous examples comparing Warner Bros. Discovery’s original art and output by Midjourney and it goes into depth of representatives of the AI company admitting they don’t seek permission to use work protected by copyright as well as its use by individuals posted to various social media sites like Reddit, Instagram, Discord, and more.

Warner Bros. Discovery is seeking damages as well as the court to block Midjourney from copying, displaying, or distributing its intellectual property. It also wants Midjourney to stop offering AI tools without copyright protection measures.

(New) Diamond “Re-Evaluates” its Online Services

Just as (New) Diamond announces that they’re moving their Previews catalogue to a digital only offering, and with it the potential for ordering that opens, they have now told retailers they are “re-evaluating” its online services such as ComicSuite and Previews Pullbox.

No one should be surprised by this announcement.

ComicSuite is a suite of tools for retailers’ point-of-sale system that’s geared specifically for comic shops. It was built to take advantage of Diamond’s data to help with ordering and re-ordering as well as manage customer subscriptions.

Previews Pullbox launched in June 2021 and was a service that allowed comic shop customers to manager their own preorders and subscriptions. It was initially announced in February 2018 but suffered delays. In the initial announcement it said it had 300 comic shops using it and over 17,000 customers. It allowed them to use the Previews website to place orders directly with their local comic shop. It’s unknown how much it was used since its launch.

With upcoming Previews going digital only, it provided a great opportunity to integrate with both making ordering by customers and shops even easier.

Specifically, for shops that are still using ComicSuite:

  • The point-of-sale system will continue to run but automation of subscription management from the web and store will cease to function as well as reporting shortages/damages, and general ordering.
  • Stores can still use the point-of-sale system but will need to get support from Retail Hero’s Retailer Management Hero (RMH) or a third party.
  • RMH might cease to function if the user license or software license expires.

In short, retailers still using this needs to find alternatives and fortunately there are alternatives that have been on the market such as Comic Hub (hell we easily built our own when I ran a shop back in 2000).

It’s no surprise that Diamond’s digital tools are degrading as key staff that handled it have left the company. Add in short pickings due to publishers halting their shipments to (new) Diamond over lack of payment, and it goes intot he pile of good ideas in the comic industry executed poorly and dying a much needed death.

IDW Publishing will join Sweet Shop ahead of the app’s upcoming launch set for later summer 2025. IDW Publishing and Sweet Shop will be bringing comics such as Beneath the Trees and officially licensed Teenage Mutant Ninja Turtles publisher’s works to even more potential readers in an all-new app. 

IDW will join a number of North American comics publishers, including Image Comics, as among the first to offer their robust catalog of comics to fans via Sweet Shop. Featuring the entire IDW Publishing and Entertainment catalog, as well as the Top Shelf Productions’ full list of titles, fans will have unparalleled access to some of their favorite creators, artists, and stories.

TikTok Sale Deadline extended for 75 Days

TikTok

President Trump has announced that he is extending the sale deadline for TikTok by 75 days. The reason given was the need for more time to hash out a deal that would allow the social media platform to continue to operate in the United States.

ByteDance, the Chinese company that owns TikTok, must find a non-Chinese buyer for the app or it will be banned under a law passed in 2024. The original sale date was extended to April 5 by President Trump by executive order on his first day in office. The app had gone dark just before that executive order but was later restored.

While there have been numerous rumors and reports of interested buyers, ByteDance released this statement today:

ByteDance has been in discussion with the U.S. Government regarding a potential solution for TikTok U.S.  An agreement has not been executed.  There are key matters to be resolved.  Any agreement will be subject to approval under Chinese law.

While a bit off the path for our site, the platform has about 170 million users in the US and has become a growing community and platform to promote comic books and tabletop games.

The administration had previously stated it had confidence a high-level agreement would be in place by the deadline.

Virtual Tabletop Hedron Exits Open Beta with Public v1, Launching Mobile App, New Features, and Creator Tools

New Tools

New tools are also launching with v1.0 to streamline system creation, testing, and implementation so that GMs can enhance their play sessions more easily. The Mechanics Sandbox allows users to actively test rule systems as they are building for quality assurance without pushing the new mechanics live, while new “ad hoc” system design tools allow GMs to save rules to build out systems while in the middle of a session without interrupting the game. Other niche features, such as automatically assigning items to players at the beginning of a campaign, are also included.

Guild Program

In addition to the features designed to help users create their games, Hedron is partnering with long-time collaborator Nine Realms Agency to help those users bring their games to market. The new Hedron Guild Program will identify and support creators whose systems are ready for playtesting, crowdfunding, and/or publication to gain marketing support and consulting.

The update also sports a UX overhaul with a refreshed look, quality-of-life improvements, and hundreds of bug fixes to make the user experience smoother.
