Sparkle Pop Steps into the Consigned Goods Craziness of Diamond’s Bankruptcy Asking for Relief

Sparkle Pop has filed a motion “for relief from the automatic stay to exercise its rights under applicable state law with respect to the goods remaining in a distribution facility owned and operated by Sparkle Pop.” One of the ongoing fights in Diamond‘s bankruptcy concerns consigned goods provided by publishers and still “held” by Diamond. Publishers of course want their inventory back while Diamond claims it has a right to it so it can sell the product and pay back creditors. The inventory is currently being stored in a facility run by Sparkle Pop, one of the winners of the bidding for Diamond’s assets during the bankruptcy.

In the filing, Sparkle Pop states there are “8,250,936 units of these goods being stored at the Mississippi Facility.”

Sparkle Pop also states it is owed $641,430 as of April 2026 and has not received its rent payments from (old) Diamond since November 2025. Rent is $125,000 a month. Sparkle Pop previously filed an administrative claim for $580,000 in March.

Sparkle Pop also takes a bit of a jab at Diamond, and its Trustee Morgan W. Fisher, claiming insurance on the goods being stored is not being maintained. While the facility is insured, the goods are not. This is part of the argument by publishers that the previous agreement between them and (old) Diamond is now void and in some way support their argument and claim. The agreement between (old) Diamond and publishers states insurance will be maintained. The publisher’s argument is that when that insurance lapsed it was a violation of their agreement and thus negates their contract triggering a process laid out in the contract where they would get back the consigned goods.

Sparkle Pop goes on to state that the goods are taking up so much space, it denies Sparkle Pop’s use of the facility for its own goods and ability to conduct and operate its own business.

Sparkle Pop is, in effect, being denied the value of the assets that it purchased through the Asset Purchase Agreement.

The distributor is renting additional storage space at its “sole (and significant)” cost to store its own goods which also means additional insurance for the new location. Even if (old) Diamond’s consigned inventory is moved, it’ll be further cost to Sparkle Pop to move their inventory to the facility and space currently being taken up by (old) Diamond. There’s also the increase expenses of just managing and having to work around (old) Diamond’s inventory.

In short, Sparkle Pop is now arguing it is suffering damages from (old) Diamond’s consigned goods being stored in their facility.

Sparkle Pop is looking to be for all of its fees and costs related to the consigned goods or it could exercise its “rights and remedies under Mississippi law to, among other things, assert a warehouseman’s lien on the consigned goods and/or take the necessary steps, under applicable law (or with the consent of the parties), to arrange for these goods to be removed from the Mississippi Facility.”

A “warehouseman’s lien” allows the warehouse to retain possession of the goods on its premises until the outstanding charges or depts are paid by the owner of the goods. It’s a security to make sure the debts are paid. If the debts are unpaid, they could then sell the goods to recover the unpaid amounts.

What’s not mentioned is the accusation that Sparkle Pop is still selling the consigned goods in violation of a court order. The Ad Hoc Committee of Consigners in a filing has evidence and accused the distributor of continuing to do so.

The extensive filing, which you can see below, includes a listing of the consigned stocked currently being held. At 125 pages, it’s a lot to go through, but you can see what comics, publishers, and creators are impacted by this mess. It’s not everything, there’s publishers missing that are currently fighting in court, but it highlights 14 publishers.

Over 1000 Hollywood Professionals come together to Oppose the Paramount-Warner Bros. Discovery Merger. Will Comic Creators Join?

Paramount is poised to be the new owner of Warner Bros. Discovery with a vote by WBD stockholders taking place in late April to approve or reject the deal. Paramount will spend a proposed $111 billion to take over the company that includes HBO, HBO Max, Warner Bros., DC Comics, and more. The deal is unlikely to face scrutiny from the federal government, Paramount’s Ellisons are close with the Trump administration, but is facing pushback elsewhere. California Attorney General Rob Bonta and colleagues in other states are pushing against the deal, likely opposing the federal government who will approve the deal. There’s also the chance of stipulations for European approval, but an outright block of the deal is unlikely.

Now, over 1,000 performers, creatives and other industry professionals signed a letter, which was organized by groups including the Committee for the First Amendment, the Future Film Coalition, the Writers Guild of America and the Democracy Defenders Fund, to oppose the merger.

The letter states the deal would:

  • Consolidate an already concentrated media landscape, reducing competition at a moment when our industries—and the audiences we serve—can least afford it. The result will be fewer opportunities for creators, fewer jobs across the production ecosystem, higher costs, and less choice for audiences in the United States and around the world.
  • It would reduce the major U.S. film studios to four.
  • Media consolidation has accelerated the disappearance of the mid-budget film, the erosion of independent distribution, the collapse of the international sales market, the elimination of meaningful profit participation, and the weakening of screen credit integrity.

The Paramount-Warner Bros. Discovery deal has a direct impact on the comic industry which has yet to organize against it. The purchase would include DC Comics as well as whatever deal the comic publisher has with Milestone Media and Wonder Comics.

It’s unknown what the exact impact would have on the publisher but it would consolidate television and film, limited avenues for comics to see their creations to come to the big and small screen.

Paramount also currently licenses some of its property to IDW Publishing, it’s unknown if this would continue with the company now directly owning a comic publisher. The loss of the properties by IDW would negatively impact a comic publisher which has been one that has a history of indie releases.

The deal also puts Paramount deeply in debt creating an even shakier future for the company. It’ll need to bring down its debt and that could impact some of the purchased assets like DC.

Comic creators can sign the “Block the Merger” open letter to make sure their names are included. But, this is a merger that has the potential of major reverberations within the industry and opens up numerous ethical questions for creators that have yet to be discussed by the industry.

Paramount has released a response to the letter:

We hear and understand the concerns that some in our creative community have raised and respect the commitment to protecting and expanding creativity.

Importantly, as creators we know firsthand that this is also a moment when the industry has been facing significant disruption—and the need for strong, creative-first and well-capitalized companies that can continue to invest in storytelling has never been greater.

This transaction uniquely brings together complementary strengths to create a company that can greenlight more projects, back bold ideas, support talent across multiple stages of their careers, and bring stories to audiences at a truly global scale—while strengthening competition by ensuring multiple scaled players are investing in creative talent.

We have been clear in our commitments to do just that: increasing output to a minimum of 30 high-quality feature films annually with full theatrical releases, continuing to license content, and preserving iconic brands with independent creative leadership —ensuring creators have more avenues for their work, not fewer.

We understand the concerns raised as a result of the disruptions caused to our industry by COVID, entry of big-tech, and changes in consumer behavior, but we promise this: Paramount remains deeply committed to talent, and this merger strengthens both consumer choice and competition, creating greater opportunities for creators, audiences and the communities they live and work in.

The Super Mario Galaxy Movie, Project Hail Mary, and The Drama repeat 1…2…3…

The Super Mario Galaxy Movie

The weekend box office was very similar to the previous week when it came to the top five films. The Super Mario Galaxy Movie added an estimated $69 million to its domestic total bringing that to $308.1 million after a little over 2 weeks. Internationally, at added $138.2 million over the week to bring that to $320.6 million which means the film has grossed $628.8 million so far this year.

Project Hail Mary held on to second place with $24.6 million to bring its domestic total to $256.7 million. Over the week, it also grossed $50.4 million internationally where it has now grossed $254 million since opening. That brings the worldwide total to $510.7 million.

The Drama held on to third place with $8.7 million. The controversial film has now grossed $30.8 million domestically. The international total remained at $11.9 million and it has now grossed $42.7 million worldwide.

You, Me & Tuscany is a new film debuting in fourth place. It grossed $8 million domestically and $1.1 million internationally for $9.1 million worldwide.

Hoppers slipped one spot to round up the top five. It grossed $4.1 million domestically to bring that total to $157.1 million. Internationally, the movie has grossed $197.3 million for a worldwide total of $354.4 million.

In comic related movies…

Demon Slayer: Kimetsu no Yaiba- The Movie – Infinity Castle remained at $136.9 million domestically. Internationally, the movie added a a little and has now grossed $601.7 million. Its worldwide gross is $738.7 million.

All You Need Is Kill remained at $695,290 domestically and internationally at $46,201 for a worldwide gross of $741,491.

Jujutsu Kaisen: Execution remained at $16.6 million domestically. Internationally, it also sits at $27.9 million for a worldwide gross of $44.5 million.

Chainsaw Man – The Movie: Reze Arc remained at $43.4 million domestically. Internationally, the movie has grossed $118.9 million. Worldwide, the movie has grossed $162.3 million.

Numbers have 64 movies grossing $126,949,737 from 30,219 theaters for an average of $4,200.99 That is compared to last week’s 77 movies grossing $200,001,511 from 30,082 theaters for an average of $6,648.54.

D’Orc #3 is a solid and fun issue with some nice twists and action and entertaining art

D’orc is being followed by an annoyingly large and ominous Dwarf aimed on erasing him from existence. For real. Like with a potion from the Silver Witch. Is that even possible? To permanently be erased from existence? Probably, because magic is real. D’orc faces off against a real threat with a giant hammer. Things will happen that will change his fate forever. Or he’ll get wiped from existence. 50/50 chance on this one.
