SOPA and the Comic Book Industry

On Friday, news broke that Marvel Entertainment and Disney both support the Stop Online Piracy Act (SOPA), H.R. 3261.  That legislation in the House of Representatives as well as it’s similar sister legislation in the Senate, the Protect IP Act (PIPA), S. 968 and S. 978, is the latest effort of copyright holders to crack down on the rampant piracy online.  Both pieces of legislation are broken and would do little other than to stifle technical innovation and free speech, but that hasn’t stopped the entertainment industry from spending over $1.9 million to get the legislation passed.

The legislation’s main thrust is providing tools to stop foreign infringing websites from being accessed in the United States and penalizing those websites.  Actions such as seizure, cutting off of funds and stopping of advertising are all methods that would be legal through this legislation.  Some of these techniques are currently being used today in mass seizure of websites by I.C.E.  The problem is, the legislation wouldn’t solve the problem.

The legislation is vague forcing websites, hosts, advertisers and payment systems to create a blacklist blocking offending websites from being accessed.  An internet blacklist is a technique employed by such stellar countries as Iran and China.  The problem is that this “tech fix” doesn’t solve the issue at all.  The websites can still be accessed in foreign countries, by masking your location and already there is a Firefox plug-in to get around such censorship.  There’s a reason that a group of 83 Internet inventors and engineers sent an open letter to members of the United States Congress voicing their opposition.

It would also allow mass seizures without due process by court order.  Websites would be able to respond and fight the seizure, after the act has been done.  So, in that year you spend in court fighting, your website is down.  Expect this to be used in retaliatory fashion.  I.C.E. has already shown they are utterly incompetent when it comes to this technique, usually catching innocent websites in the mix.  Keep in mind too that websites and individuals could share IP addresses and the whole process gets murkier.

CensorshipThe legislation also allows internet service providers to block websites that are deemed to be health risks to the public and they are protected from action by their customers.  There doesn’t have to be proof that there’s a risk, they can just do it.  So much for Net Neutrality.

What bothers to me is that the legislation also kills creativity and threatens innocent fans celebrating the entertainment they love.  We’ve posted videos of video game players doing walk throughs of games, the video of a wedding party entering to Chris Brown’s Forever, and our recently posted spoof videos of the Dark Knight Rises trailer, video of folks covering a song or singing karaoke, all would be illegal under SOPA.  Justin Bieber became famous covering other artist’s songs on Youtube, he could now be jailed for that, which is why this is called the “anti-Bieber bill.”  Prince has sued a mother for posting a video of her kid dancing to one of his songs.  Copyright holders as is can’t be trusted with the laws we have, we want to give them more?

Even crazier, just linking to an infringing website could get you in trouble.  There goes my Facebook status and Twitter posts and say bye-bye to Tumblr.

When it comes to the comic book industry, websites dedicated to art and fan art, like DeviantArt, could be caught in seizures.  A search on the popular website found 48423 items returned for Spider-Man, 59857 for Iron Man, 31760 for Captain America and 90334 for X-men

I’m not even going into the hypocrisy of elected officials writing pushing this legislation.  Piracy runs rampant in government offices (I’ve seen it first hand), but the RIAA has been caught torrenting as well as foreign elected officials and copyright holders.  That’s the definition of hypocrisy.

And that brings us back to the comic book industry.  Marvel and Disney have stated their support for the legislation.  We’ve reached out to them, as well as other comic book publishers for their stance and to explain their stance on the legislation.  Pressure has been brought upon other supporters of the legislation and resulted in a positive outcome (though there’s disagreement how sincere GoDaddy really is), but until I get clarification from Marvel I don’t want to call for a boycott quite yet.

I am calling for publishers to state their stance and make their opinion public, sign this petition and show as a consumer you want to know too so you can make a better informed decision as to whether you want to continue your support.

You can take action right now and voice your opinion on the legislation.  Tell your elected officials this legislation “shall not pass.”

Congress and the House Judiciary Committee where SOPA remains in mark-up are currently on break, but when they return in January it will be one a hot topic and debated early in the Congressional session.  We’ll bring further coverage of this important debate and legislation and expect further calls to action.

Update: Gizmodo has a list of all of the companies and organizations supporting SOPA according to the House Judiciary Committee, there’s also this crowd sourced Google Doc.  Take a moment to call and email some of these companies to voice your displeasure.  If you live in the United States, you can write your Representative and Senators through this action hosted by the Entertainment Consumers Association.

CBLDF Joins Celebration of Comics at
The Brooklyn Comics and Graphics Festival

On Saturday, CBLDF heads across the bridge for The Brooklyn Comics and Graphics Festival, a one-day show celebrating comics and graphic design. This free festival takes place December 3, from noon to 9:00 p.m. at Our Lady of Mt. Carmel Church (275 North 8th Street, Williamsburg, Brooklyn), and features an electrifying assortment of creators, publishers, exhibitors, and programming.

CBLDF will be on hand, exhibiting with exclusive signed premiums, including a wide range of autographed graphic novels from Jaime Hernandez, Mike Mignola, Jim Woodring, Dan Clowes, and more. The money raised during the festival will support CBLDF’s defense of an American citizen who faces prosecution Canada because of the comics he carried on his laptop. Come out and support free speech and comics this weekend at The Brooklyn Comics and Graphics Festival!

Alex Cox Named CBLDF Deputy Director

The Comic Book Legal Defense Fund is pleased to announce that Alex Cox has been named to the position of Deputy Director. In this new capacity, his responsibilities will expand to include full oversight of the CBLDF home office and fundraising program. Cox joined the CBLDF in the fall of 2010 as Development Manager.

Since joining the CBLDF last year Cox has improved the organization’s membership program and convention presences. Under Cox’s watch, membership in both the retailer and individual capacities has shown dramatic increases. Cox has also overseen the creation of a more robust volunteer program in the New York home office. Prior to CBLDF, Cox was a 15-year veteran of comics retail, including owning and managing the nationally recognized comic book store ROCKETSHIP.

Speaking about the promotion, Cox said, “I’m extremely grateful to be in a position to help the comics community fight back against anyone that would threaten free expression in this art form that we all love. As a comic fan and student of the art form for close to 30 years, I never thought that I would see anything like the panic caused by SEDUCTION OF THE INNOCENT in my lifetime. But with the current case in Canada, the creeping specter of censorship and persecution is rearing its head again, making the CBLDF even more important. I’m proud to be a part of it and I look forward to working with our members, retailers, and the creative community in the years to come.”

The Comic Book Legal Defense Fund congratulates Robert Corn-Revere, who represents the organization as General Counsel, on his victory in CBS v. FCC in the Third Circuit Court of Appeals.

The federal agency fined CBS Corporation television stations $550,000 for airing the “wardrobe malfunction” that exposed singer Janet Jackson’s breast during the 2004 Super Bowl halftime show. The Third Circuit had previously thrown out the fine, but the Supreme Court remanded the case for reconsideration following their ruling on the fleeting material policy in Fox v. FCC. The Third Circuit re-affirmed its decision in a 2-1 split. Robert Corn-Revere argued the case for CBS.

CBLDF Be Counted Membership Drive
Closes at Midnight Tonight!

Last month, the Comic Book Legal Defense Fund asked the comics community to Be Counted as members of the organization, and set a fundraising goal of $100,000 by October 31 to support their important legal and education work. Today, the Fund has raised over $77,000 of that goal, thanks to the generosity of those who heard the call to Be Counted, and the professional community supporting the campaign. Today, the CBLDF is asking anyone who hasn’t joined or renewed their membership the organization yet to sign up to protect free speech, and to take advantage of some of the unique rewards they’re offering to thank supporters during the drive!

All members signing up to Be Counted by 12 Midnight pacific time on October 31 will be able to receive signed thank yous, including the 2011 CBLDF Member Card featuring Green Lantern, and signed by Geoff Johns, with other rewards for members signing up at higher levels including signed prints from Neil Gaiman, Garth Ennis, and original art from Matt Wagner, Jeffrey Brown, Cliff Chiang, and more. Legal Action

Last September, the CBLDF contributed the first installment of the $150,000 in legal fees needed to defend Brandon X, an American citizen facing a minimum sentence of one year in Canadian prison and registration as a sex offender because Canada Customs alleges that Japanese horror and fantasy comics on Brandon’s laptop are child pornography. His case is important because it raises important precedent questions about the artistic merit of comics and the rights of readers and artists traveling with comics on their electronic devices. The CBLDF needs your help to pay the lawyers defending this case because we seek to establish a precedent that protects comics in Canada and influences courts in the United States.

Beyond Brandon’s case, the CBLDF needs your help to ensure we are able to continue our other important program services. Your membership dollars will pay for our membership in Media Coalition, which helps us track and fight unconstitutional legislation. You will also ensure we have the resources we need to pay our monthly retainer for routine First Amendment legal work.

Education

The CBLDF continues to assist librarians and retailers when comics and graphic novels are challenged. Often this happens on a case-by-case basis, during which CBLDF staff gather defense materials for each individual incident. We currently seek funds to develop more substantial preventive tools, including joining an important anti-censorship coalition that protects the right to read.

Retailers — Be Counted In Diamond’s CBLDF Member Drive!

In this month’s Diamond Previews, Retailers and Comic Shop Owners will find the most important item they will order this year — their CBLDF Retailer Membership! Retail Members are a vital component to the ongoing work of the CBLDF, and this Thursday is the deadline to sign up your store on the Previews order form and support the Fund en masse!

With the help of the retail community, over the past year the CBLDF has supported the rights of comic stores by fighting unconstitutional laws that would have affected the sale and display of comics in Utah, Massachusetts, Alaska, and California. The CBLDF’s efforts were even cited by the U.S. Supreme Court in Brown v. EMA, where the CBLDF’s brief outlining our industry’s struggle with censorship in the 1950s and beyond was included as part of the court’s decision to strike down a California law that would have given states the right to regulate violence. The CBLDF continues to keep watch and fight against laws that affect the Direct Market’s ability to do business.

Cartoonist Fights for Free Speech in Kuala Lumpur

Zulkiflee Anwar Ulhaque, better-known among comic fans as Zunar is pushing against the Malaysian government in a fight over free speech and censorship.  In September 2010, police arrested Zunar on a sedition charge just hours before a book release party.  He’s one of the few cartoonists willing to take on the government in the country.  The government claimed he violated the Printing Presses and Publications Act because he didn’t have a license to publish.  He was later released without charge.

The majority Muslim nation is finally easing it’s strict censorship laws, but that’s only after decades of repressive and strict control over free speech.  Last month, authorities banned a television commercial made by famous actors and musicians urging Malaysians to exercise their right to vote and featuring both government and opposition politicians lip-synching to a pro-democracy song.  The government claimed it wasn’t ok’ed to air.

While there is some easing of laws in the lead up to elections that must be called in 18 months, that doesn’t include sedition laws which are used to prosecute against speech the government doesn’t like and you’ll still need to apply to print if you don’t have one already.

As a whole the Asian region has issues with freedom of political speech and freedom of expression, especially those that falls in the category of criticizing the government.  Luckily many are turning to the internet where such laws can’t be enforced.  But, Zunar has already felt the force of the existing laws.  While there’s lots of talk, the real test will be if we see political cartoons by Zunar printed in his nation’s newspapers.
